EB-5 Requirements

You need to make a capital investment of either $500,000 or $1,000,000.

The EB-5 visa requires that you make a minimum investment of $1,000,000 into a commercial enterprise. In some circumstances, the amount required can be reduced to just $500,000. You may qualify for the lower amount if you are making the investment in a company that is based in a rural or economically depressed area. You’ll need to demonstrate that the funds being used were gained through legal means, which will involve submitting a good deal of proof and paperwork that will be closely reviewed.

Your investment must result in 10 new jobs for American workers.

After two years, you will have to demonstrate that your company has resulted in 10 new jobs for U.S. workers. This process will take place at the end of your conditional 2-year residency. You cannot count yourself or your family members towards the job creation requirement. However, you may be able to demonstrate that your investment created ten indirect jobs; that means the jobs may not be with your investment company, but they were created as a result of the work you are doing.

You must invest in a for-profit commercial enterprise.

Fortunately, this covers a wide spectrum of companies and investment opportunities. It does, however, mean that you cannot invest in any non-profit organizations. Other than that, most commercial enterprises are eligible, including investing in your own company, an existing company created after 1990, or a regional center that administers EB-5 projects. You have to be actively engaged in the company you invest in.

You don’t have to run or control the company yourself, but you will need to remain involved in the company. How heavily you are involved in the company will depend on what kind of company it is and where you end up living. However, you don’t have to work full time for the company and will be free to seek other employment if you wish once you’ve attained conditional residency.
